This Privacy Policy (“Policy”) explains how Watch Systems, LLC (“Company,” “we,” “us,” or “our”) collects, uses, discloses, protects, stores, and destroys personal information in connection with the use of OffenderWatch® Company Applications and Company’s website, offenderwatch.com (“Website”) (collectively, the “Applications”). It applies to every User who accesses or uses the Applications, no matter where the User lives. This Policy is a part of any agreement that you may have with Company governing your use of the Applications.
“Biometric Information Policy” means Company’s policy for collecting and using biometric data, which is part of the agreement for Remote Express, which can be accessed at /offender/biometricinformationpolicy.html.
“Company Applications” means the applications that User can access or that Company makes available through the Website or for download on a mobile device, including Remote Express and the Family Safety App.
“Family Safety App” means the Offender Watch Parent and Offender Watch Child suite of mobile applications that provides real-time updates, instant notifications, and resources to help parents monitor family members’ locations or search for registered sex offenders.
“Remote Express” means Company’s application that allows eligible Users who are subject to sex-offender registration obligations submit registration updates remotely.
“SMS Terms & Conditions” means Company’s policy for communicating through SMS messages, which can be accessed at /offender/smstermsandconditions.html.
“User” means you, the individual who accesses or uses the Applications. “You” and “your” refer to the User.
Information which is publicly available or deidentified or aggregated information is not personal information. We may collect the following categories of personal information in connection with your use of the Applications:

Company may disclose personal information to third parties as described in this Section. Company does not disclose personal information to third parties, except as described in this Policy. Other than law enforcement agencies, which are subject to reporting and disclosure laws, third parties to whom Company discloses personal information are required to maintain the confidentiality of such information and are prohibited from using personal information for purposes other than those agreed. As used in this section, “disclose” means transfer, send, or otherwise make available or accessible to another person or entity, but does not include selling or sharing as those terms may be defined under applicable state privacy and data protection law.
Law enforcement. Company may disclose your Identity Information and Internet and Network Data to law enforcement to comply with Company’s legal obligations and enforce Company’s legal rights across the Applications. Remote Express discloses Identity Information, including the Registration Data, Commercial Information, specifically Audit records, Location data, Photographs, to a User’s registering law enforcement agency as required for sex offender registry compliance. The Family Safety App discloses tips regarding offenders as permitted through lawful request.
Technology Service Providers. Company may disclose Identity Information, Commercial Information, Internet and Network Data, Location Data, Professional Data, Photographs, and Sensitive Information to its technology service providers to support platform operations across the Applications, including for Application hosting, sending communications, managing form submissions, evaluating Website performance, engaging in Company business, maintain and securing the Applications, managing location services and functionality, and otherwise providing the services.
Third-party Payment Processors. You disclose Payment Information, Identity Information, and Commercial Information to Company’s third-party payment processors when completing a financial transaction. Payment Information, such as credit or debit card details, are not disclosed to Company. Company receives confirmation of payment and subscription or services purchased.
Third-Pary Transactional Parties. Company may disclose Identity Information, Commercial Information, Internet and Network Data, Location Data, Professional Data, Photographs, and Sensitive Information, to the extent permitted by law, including during any due diligence process, in the event of any contemplated or actual re-organization, merger, sale, joint venture, assignment, transfer, consolidation, restructuring, bankruptcy, or other disposition of all or any portion of Company’s business, assets, stocks, or an Application.
Sensitive Information. Your location data is disclosed as described above. Your biometric data is not disclosed to any third party. Company does not use or disclose your sensitive personal information for purposes other than those allowed under applicable state privacy and data protection laws, including Section 7027(m) of the California Consumer Privacy Act Regulations. Biometric data is not disclosed to any third party, as described more fully in the Biometric Information Policy.
Company may disclose or otherwise make available your Identity Information, such as IP address, Location Data, and Internet and Network Data with unaffiliated third parties with whom Company has a business relationship for ours or for their own business and advertising/marketing purposes. Such third party’s use of the personal information is subject to their privacy policy and data practices. These disclosures of personal data may also be considered a “sale” of personal information or “sharing” of personal information for “targeted advertising” under applicable state privacy and data protection laws.
Company utilizes Google Analytics, which uses cookies and similar technologies, to measure Website traffic and engagement for the purpose of improving the Website. Cookies and similar technologies are small pieces of text or code sent to your browser or device when you visit a webpage. Such technologies store information about your visit including IP address, referral source, pages visited, navigation path, pageviews, bounce rate, session length, new versus returning visitors, device, browser, operating system, and location information. Google may collect information about your use of other websites, applications, and services. You may have the right to opt out of such sales or sharing of personal information pursuant to the methods enumerated in Section 10. Company implements technical and administrative safeguards including encryption in transit and at rest, access controls, and audit logging. Remote Express is hosted through a CJIS-compliant infrastructure via Nlets. No system accessible through the internet can guarantee absolute security.

Depending your state of residence, and the Application being used, you may have the following rights regarding your personal information.
Because the Applications operate in a law enforcement context, some standard consumer privacy rights may be limited or subject to legal exceptions.
In certain Applications, you may exercise your rights from the settings page or the My Account page. You may unsubscribe from future communications by following the instructions within the email or text messages. You may also contact us using one of the methods below. When requests are made outside of the Application or communications, we may take steps to verify your identity. We will respond to your request within 45 days, or such other period required by applicable law. In the event we cannot respond to your request, we will notify you of the reasons for the delay and the extended period for response. If we determine that we cannot respond to your request for any reason, we will notify you of the reasons for taking no action and for any instructions as to how to appeal. You may use an authorized agent to exercise your rights on your behalf. The authorized agent must provide us with proof of your written permission (for example, a power of attorney) that demonstrates authorization to submit a request on your behalf. An authorized agent must follow the process described above to make a request and must verify the agent’s own identity.

The Family Safety App allows parents or guardians to track a child’s location and communications, by adding children to an account created by the parent or guardian. The Family Safety App collects name, phone number, contact list, device type, and location data of the child connected to the parent or guardian’s account. This information is not made publicly available. Such information is used in accordance with this Policy. To review or delete a child’s personal information, an account holder may contact Company using one of the methods in Section 10. To prevent further collection and use, please delete the account on Family Safety App or the child connected to the account. Location Data that qualifies as sensitive information, as described above, in addition, it collects name, phone number, contact list, and device type of a known child.
Neither Remote Express nor the Website are directed at individuals under 18 years of age without authorization by a parent or guardian or by law enforcement agencies.
Company may update this Policy from time to time. For a material update, Company will revise the effective date and version number for this Policy and notify Users through the Applications. Historical versions are available upon written request.
Remote Express collects mobile phone numbers to send text messages as part of its service and compliance-notification program. The SMS program is governed by the SMS Terms & Conditions.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Mobile opt-in data and consent obtained for text messaging will not be sold, shared, rented, released, transferred, or disclosed to any third party for any purpose unrelated to the delivery of the SMS notifications described in the SMS Terms & Conditions.
